Work Permit Application Procedures under Decree No. 219/2025/ND-CP

Decree 219/2025/ND-CP updates the process for foreign workers to obtain work permits, aiming to simplify procedures and improve the business and investment environment.

When a permit is required: Most cases of employing foreign workers require a permit, except certain intra-company transfers within the 11 WTO service sectors where the worker has at least 12 months of prior employment.

The five-step process:

• Post a Vietnamese recruitment notice at least 5 days in advance;
• Prepare the application file;
• Submit to the provincial People’s Committee 10–60 days before the intended start date;
• Receive the permit decision within 10 working days;
• Sign the labour contract (if applicable).

The file includes a health certificate, passport, criminal record, diplomas (with consular legalisation/apostille for foreign credentials) and the employer’s justification statement.
